What we collect
Immigration work requires detailed information. Depending on your case we may collect your name, contact details, date of birth, nationality, passport and immigration history, details of family members and their status, financial and employment information, and qualifications. Where relevant to your application, this may include sensitive information such as health, religion or ethnic origin, and information about any criminal matters or immigration breaches.
Why we use it and our legal basis
We use your information to advise on your case and prepare and submit applications on your behalf (performance of our contract), to meet the record-keeping requirements of the IAA and other legal duties (legal obligation), to run and protect our practice (legitimate interests), and, where you agree, to send you updates (consent). Where we handle sensitive information, we rely on your explicit consent, the need to establish or defend legal claims, or substantial public interest.
Who we share it with
We share information only where your case needs it: with the Home Office and its partners to make your application, with interpreters, translators or barristers where required, and with our professional advisers or insurers. The IAA has a legal power to inspect our client files, which means an auditor may see your file. We may also disclose information where the law requires it.
We do not sell your information.
How long we keep it
We keep client files for 6 years after your matter ends, to meet IAA requirements and to deal with any later query or complaint. Financial records are kept for six years. Other records are kept only as long as needed.
Your rights
You can ask us to give you a copy of your information, correct it, delete it, or restrict how we use it, and you can withdraw consent or object to marketing at any time. Contact us using the details above and we will respond within one month. Some records we must keep by law or by our regulator and cannot delete on request.
