Yes. A small UK business can obtain a sponsor licence.
There is no minimum turnover or minimum number of employees that a company must have to apply for a sponsor licence. However, the company must be genuinely and lawfully operating in the UK, be managed by suitable people, and have systems capable of meeting its sponsor duties.
A newly established company, or one that has been operating for less than 18 months, can also apply. However, additional document requirements apply to these companies.
Who counts as a small sponsor?
A business will usually be treated as a small sponsor if it meets at least two of the following conditions:
- Its annual turnover is £15 million or less
- Its total assets are worth £7.5 million or less
- It has 50 employees or fewer
The small sponsor definition mainly affects certain Home Office fees. It does not mean that the application will be approved more easily or that fewer documents will be required.
As at August 2026, the Worker sponsor licence application fee is £611 for small or charitable sponsors and £1,682 for medium or large sponsors.
Is registering a UK company enough?
No.
Registering a limited company with Companies House does not, by itself, show that the company is ready to obtain a sponsor licence.
The Home Office may examine whether the company is carrying on genuine commercial activity, the sector in which it operates, its financial transactions, its current organisational structure, and why it needs the proposed sponsored role.
The proposed role must be appropriate to the company’s activities and size. A role that is artificial or not based on a genuine business need may weaken the application.
What areas does the Home Office examine?
The following areas are generally considered together as part of an application:
- The company’s genuine and lawful UK operations
- The adequacy of the supporting documents
- The suitability of the Key Personnel
- The proposed role and job description
- The company’s ability to pay the salary
- Human resources and record-keeping systems
- Whether the sponsor duties are understood
Before deciding the application, the Home Office may carry out a compliance check and assess whether the company’s current systems are capable of meeting its sponsor duties.

Being a small company is not a problem in itself. A greater risk arises when the documents and explanations are inconsistent with one another.
Is the Authorising Officer merely a name on the application?
No.
The Authorising Officer is the person with senior responsibility for the company’s sponsorship activities. This person must sign and date the application submission form. The Authorising Officer’s responsibility continues after the worker starts employment.
The company must also nominate a suitable Level 1 User and ensure that its Key Personnel understand their responsibilities.

In our experience, the existing number of employees is not decisive on its own in applications by small companies.
What matters most is whether the evidence of commercial activity, the company’s financial position, the proposed role, the salary, and the sponsor compliance systems form a consistent overall picture.
Each document may appear reasonable when viewed on its own. However, the application is weakened if bank transactions, customer contracts, the organisation chart, and the job description present conflicting accounts of the company.
For this reason, simply collecting the required documents is not enough. Taken together, the documents need to explain what the company does and why it needs the new role.
Once the mandatory minimum criteria have been met, the remaining assessment may depend on the judgement of the caseworker considering the application. If the caseworker suspects that the company was established only to obtain a sponsor licence, the company may be selected for a digital compliance check, including an interview. Recently, and as at August 2026, we have frequently seen companies with few employees, limited commercial activity, and a recent incorporation date selected for digital compliance checks.
Can your adviser submit the application on the company’s behalf?
A regulated immigration adviser can help prepare the application form, supporting documents, and the necessary explanations.
However, the sponsor licence application must be submitted by the company. A representative must not submit it on the company’s behalf. According to Home Office guidance, doing so can lead to the application being refused without a refund of the fee.
Conclusion
A small or newly established business can obtain a sponsor licence. However, company registration or qualifying as a small sponsor is not enough on its own.
Before applying, the company’s commercial activity, proposed role, financial capacity, Key Personnel, and human resources systems should be assessed together.
